ZONING BOARD OF APPEALS
HEARING


Dr. Joseph DAmico        Trustee of 1355 Main Street Realty Trust Case No. SP 0610

The Zoning Board of Appeals held a public hearing on Thursday, July 27, 2006 at 7:15 p.m. in Memorial Hall, 1196 Main Street, Holden, MA on the Application of Dr. Joseph DAmico for property located at 1355 Main Street for a Special Permit to alter a pre-existing nonconforming structure. Members of the Board in attendance: Ronald Spakauskas, Roy Fraser, Fred Lonardo and James Deignan.

The Chairman called the hearing to order. Since there were no objections, reading of the legal notice and list of abutters was waived. The secretary read the Application and Findings of Fact.

Mr. Doug Andrysick from Andrysick Land Surveying, representing the applicant, addressed the Board. The southerly portion of the structure will be removed and a 24 x 24 two-story addition will be constructed in its place. The lot is in conformance with the area and frontage requirements; however, the northeasterly corner of the existing building is not in conformance with the current setback requirements. It was confirmed that there would be no change in use.

R. Spakauskas asked if the applicant intended to hook up to public sewer. Mr. Andrysick said there is a sewer connection in the area of the property; however, they would not like the occupancy permit for the addition to hinge on the applicant connecting to the sewer system.

Since there were no further comments or questions, the public hearing was officially closed at 7:40 p.m.

The Board voted unanimously to approve the special permit.
